Terms and conditions for trainees

The terms and conditions are governed by the following terminology.

The person who accesses this website shall be referred to as “You”, “Your” or “Client”.

Our Company shall be referred to as “The Company”, “We”, “Us” and “Ourselves”.

“You” the Client and “The Company” meaning ourselves can be referred to as “Party”, “Parties” or “Us” either together or separately.

1. About the Company:

The courses and training made available to trainees through the site and classroom are owned and operated where applicable by Instaily Pvt Ltd. ( hereinafter shall be referred to as “The Company” or “We”, “Us” and “Ourselves” as may be the case. The Courses, Services and the Site shall be referred to as “Company Products”. ) By using the Company Products you agree to the terms and conditions as mentioned below in these terms of use.

These terms create a binding legal contract between you and the company. By using the “Company Products”, you represent that you have read, understood and agree to be bound by these terms and conditions. If you do not accept these terms and conditions you are not authorised to use the Company Products either as a whole or in parts.

2. Disclaimer:

The information provided on this site is on an “as is” basis.

It excludes all warranties related to this website and its contents or which may be provided by any third party including with relation to any inaccuracies in this site and literature of the Company.

It excludes all liability for any damage arising in connection with your use of this website.

3. General:

The Company products allow the client to learn through classroom tutoring, and recorded instruction.

You agree that these terms and conditions are agreed to with regards to your use of the Company products.

Company reserves the absolute right to revise these terms and conditions in its sole discretion and without any prior notice to you.

The Company products are subject to change at any time. If you are not satisfied with the services of the Company, you can take remedial action by discontinuing the services of the company.

You agree that we can communicate with you through email regarding privacy, security and administrative issues with relation to your usage of the Company products.

4. Fees:

Visiting the site and browsing courses is free of cost. However, the Company reserves the right to change its fee policies at any point of time.

All fees are mentioned in Indian Rupees. It is your responsibility to pay all fees along with applicable taxes as per the terms of the contract using a valid payment method which is acceptable by the Company. If you fail to make timely payments we may collect your fees due to the Company using separate collection procedures which may include engaging collection agencies and taking course to legal means.

5. Conduct:

The Company products can be used by you only for lawful purposes. You shall be solely responsible for adhering to all laws related to the use of the Company products. You cannot use the Company products to recruit or engaging in a business which is not related to us without taking advance permission from us. Granting or withholding the permission remains our sole discretion.

6. Refund:

We have a no questions asked, money back policy, for users provided the request is made within 72 hours from the time of enrollment in a course.

If the Company feels that that the refund policy is being abused by you, it remains our discretion to terminate your contract and not allow usage of any Company product without any liability to you.

It remains within the discretionary powers of the Company to revise these terms at any point of time in future without prior notice. Revisions, when they do happen shall be posted on the site.

7. Copyright:

You acknowledge that the training materials, software, information, text, audio clips, video clips, images, illustrations, artworks, designs and copyrightable materials are the proprietary property of Company and its affiliated third party providers and suppliers.

You agree that all material displayed on the website is solely for your personal use and you will not, directly or indirectly, copy, re-publish, reproduce, upload, post, transmit or distribute such material in any manner and through any media including electronic media and shall not help any person or organisation in doing so.

Company shall have sole and exclusive ownership on the intellectual property developed by us.

8. Termination conditions:

We may terminate your rights to use the Company products immediately without giving prior notice.

You are free to terminate your use of the Company products at any point of time.

In the event of termination or expiry of the contract, all provisions regarding ownership of intellectual property, disclaimer, limitation of liability, dispute resolution and any other provisions of these terms, apply after termination.

You can visit our website without revealing your identity. But we do gather data from certain areas of our website, namely:

If we receive an enquiry from you through our website you shall be requested to provide information which includes name, contact number and e-mail id.

If you register on our website to register for our training programs you shall be asked to share your name, contact number and e-mail id.

The data acquired from you shall be stored in our cloud based server. Payment details shall be collected via a secure third party site and neither we nor the third party is able to access this information once payment issues are cleared.

The information collected from you may be used by us in the following manner to serve you better:

Registering you with our website for administration purposes.

Dealing with your enquiry and giving information about our services which are relevant to the enquiry from your end.

If you visit any external link from our website, you shall be subject to the privacy policies of that organisation.

If you enroll for any of our training programs, we shall be holding your data for the period of your contract with us, which is 3 years. We are entitled to share this information with other organisations in ways which benefit you. If you do not avail of any of our training programs, we shall hold on to your data for a period which shall be not less than 2 years or unless we feel it is appropriate to hold your data any longer.

This website has been developed keeping in mind that the intended users shall be above the age of 13. Payment related data is not collected from children by us as we stay committed to protect the privacy of children online.

4. Log files:

Log files are used to manage traffic loads so that we can deliver our services in an efficient manner. We maintain log files of the traffic which hit our site but we do not link any information collected from these log files to personal information.

5. Personal information sharing:

If you enroll for any of our courses, we might ask you for a testimonial which may include photos and videos. This shall be displayed on our website and social media channels like Facebook, YouTube and Twitter. We shall not be responsible for your personal information which you have chosen to be displayed online.

6. Dispute resolution:

This privacy policy shall be governed and construed in accordance with the laws of the Republic of India. In case of any arbitrary proceedings, the courts at Kolkata shall have exclusive jurisdiction with relation to any dispute that may arise out of or in connection with this policy.

7. Merger:

If the company merges with another entity by selling its assets or files for bankruptcy, the information which the Company has received from you is a Company asset which may be transferred in connection with these types of events.

8. Changes in privacy Policy:

The privacy policies may be updated as and when required. Your usage of this site means your continued compliance to this Privacy Policy and its subsequent updates.
